I, as the parent or legal guardian of the minor named below, on behalf of myself, my child, and our heirs, personal representatives, successors, and assigns, agree to the following terms in consideration of my child’s opportunity to participate in dances, classes, social events, and other activities sponsored, managed, supported, or provided by The Oklahoma Swing Syndicate (TOSS):
1. Voluntary Participation
I acknowledge that my child’s participation in all TOSS activities is completely voluntary.
2. Assumption of Risk
I understand the risks and dangers involved in swing dancing and related social activities. I voluntarily accept full responsibility for any personal injury (including death), loss, or damage to my child or their property that may occur during any TOSS activity, even if caused in part by the negligence (but not gross negligence) of TOSS or its affiliates.
3. Waiver and Release of Liability
I release, discharge, and agree not to sue TOSS or any of its affiliates for any and all claims, demands, or causes of action arising from or related to my child’s participation in any TOSS activity—whether or not caused by negligence, except in cases of gross negligence.
4. Indemnification
I agree to indemnify, defend, and hold harmless TOSS and its affiliates from any and all claims (including attorney fees and costs) arising from my child’s negligence, recklessness, or other misconduct during TOSS activities.
5. Emergency Medical Consent
I authorize TOSS and its representatives to seek emergency medical treatment for my child if necessary during any TOSS event. I understand that reasonable efforts will be made to contact me before medical care is administered.
6. Media Release
I consent to the use of my child’s photograph or likeness—taken during any TOSS activity—in brochures, publications, videos, websites, slide presentations, and other media formats, at no charge and without further permission or compensation.
